Yes. However, it depends on the source of CBD oil. At the close of the legislative session in July 2019, a Senate Bill, S-6184A[1], was passed to regulate industrial hemp in New York. By this time, the state market had already been flooded with CBD or cannabis-derived products. However, before the Senate Bill was passed, the market was unregulated and had no guidelines at the state level.

Though this Bill is still yet to be signed by the Governor, it will allow the regulatory framework of a two-year renewable licensing once signed, for manufacturing, growing, extracting, and packaging hemp extract products.

The Bill will take care of the labeling requirements, including restrictions on a product on the proposed health programs and negative health impact warnings. It will also rope the Department of Agriculture and Markets experience to create new regulations for hemp production, cultivation, and marketing.

However, the FDA banned the addition of hemp-derived CBD products to any beverages and food items in July 2019. The ban caused products to be embargoed[2] by violators and made the products unavailable for sale. Those involved would also face a $250-600 fine.

Officials declared that the ban would be effective from October 1st, 2019. The ban also applies to hemp grown for grain and fiber. The ban is under the guise of giving proper guidelines and also guaranteeing the safety of the supply chain of farmers, processors, and manufacturers due to increased consumer interest and demand. 

The Bill lacks a process for using CBD oil products for using CBD in food, a new bill might need to support it, or an amendment could be made once the Governor signs it. There are three types of legal cannabis, medical marijuana, hemp, and recreational marijuana.

Senate Bill S1527B[3], also known as the Cannabis Regulation and Taxation Act is yet to be discussed on the Senate floor, and Senate Bill S03040[4], also known as Marijuana Regulation and Taxation Act is high-level marijuana legalization bills. These Bills intend to tackle all aspects of marijuana in one go.

If the Bills are passed, they will successfully amend the New York Agriculture and Markets Law and effectively bring regulation of hemp under New York’s State Department of Agriculture and Markets. This will give the administration direct control of the entire licensing process and make the process simpler.

There is an Industrial Hemp Research Pilot Program that’s overseen by the New York Department of Agriculture and Markets which make licenses readily available for growing industrial hemp, license for CBD processing, and processing non-CBD parts. Even after the Bills are passed, the pilot research will still continue only under the rules of processing hemp for non-research purposes for limited compliance exceptions.

Senate Bill S-6184A[[1] was passed by both houses of the New York Legislature, took issues arising from the pilot program, and provided a safe structure for the CBD industry. Hence, it will prove to be a massive step in the regulation of the first-growing industry.

However, to make the entire process smooth, there has to be more legislation written, which will be the first step in trying to make CBD oil legal. The NYSDAM currently controls cannabinoid hemp products to ensure to indicate proper health warnings and serving size of the CBD, origin details of the hemp, and the number of servings in a bottle or packet. Growers are required to follow the Good Manufacturing Practices[5] provided by the FDA under the Federal Food, Drug, and Cosmetic Act and avoid using pesticides during the cultivation and extracting process of hemp.
